THE TOPIC –

Treaties v Soft Law: The Effectiveness of International Environmental Governance in the Arctic

“ The debate over the effectiveness of treaties and soft law instruments in international environmental governance has been occupying academics’ minds for decades. The particular importance of soft law in the field of international environmental governance is often highlighted by scholars, due to its flexibility and relatively uncomplicated adoption procedure. Despite its non-binding nature, soft law affects international environmental lawmaking in a number of ways.

In 2008, the US Geological Survey discovered potentially vast petroleum resources in the Arctic waters. Along with the excitement over the discovery of twenty-two percent of world’s untapped oil and gas reserves came the concern over the environmental safety of the exploitation of the Arctic resources.

In my doctoral thesis, I have assessed the effectiveness of treaties and soft law in the protection of the Arctic environmental from the negative effects of offshore oil development – oil spills and accelerated local and global warming. During this seminar, I will discuss the theoretical underpinnings of the research and will share my findings. ”
