Presentation summary: Modern international investment law, as a set of bilateral and multilateral agreements on foreign direct investment, was initially developed as a corollary of globalization but also as a response to the need to resolve the uncertainties and inadequacies of customary international law concerning the responsibility of states for damage caused to aliens and their property. Originally, at least, the content of investment treaties has traditionally been shaped by developed countries intending to guarantee a stable and secure investment climate for their investors by mitigating political and legal risks through series protection standards that could be invoked by foreign investors and investments. Developing countries were generally inclined to accept such terms in the hope that they would lead to the promotion of foreign investment on the one hand and economic growth and development on the other. Recent treaty practice demonstrates a new trend which consists of ensuring that only responsible investments promoting the sustainable development of the host state of the investment can benefit from the protections of investment treaties. This new approach is a reaction to criticisms of the asymmetrical nature of investment treaties which have traditionally conferred rights to investors and imposed obligations on states. It is this development that we propose to address: evolution of the content of international investment agreements through the inclusion of new provisions aiming to promote responsible and sustainable foreign direct investments.
Bio: Dr. Lukas Vanhonnaeker (Lukas VANHONNAEKER - Faculté de droit - Université de Montréal (umontreal.ca)) is an Assistant Professor at the Faculty of Law of the University of Montreal where he conducts research in the field of international economic law with an emphasis on the law of international commercial transactions and international investment law and arbitration. Lukas completed his bachelor’s degree in law at the Facultés Universitaires Saint-Louis (Brussels, Belgium) in 2010 and his master’s degree in law at the Catholic University of Louvain, Belgium, in 2012. He received his LL.M. in international business law from the Free University of Brussels in 2013 and he also holds an LL.M. (2014) and a PhD (2018) from McGill University. Lukas was also a post-doctoral research fellow at McGill University before being appointed as Assistant Professor at the Faculty of Law of the University of Montreal.
