Summary
The presentation aims to interrogate the value of expropriation (i.e. reallocating ownership) as a tool in land reform generally and specifically in a South African context, in light of its proposed new categories of nil compensation in the most recent land reform proposals and considering the inherent and prevailing shortcomings and disconnects in the South African land reform programme. In this regard, a short historical background is briefly provided, followed by an exposition of the three sub-land reform programmes. The interventions with regard to the acquisition of land – adjusting the market and drafting legislation dealing with expropriation – are specifically dealt with. Finally, the question is posed whether the intended amendments providing for nil compensation specifically, will address the difficulties and disconnects. In short: is expropriation generally and expropriation without compensation indeed the “Silver Bullet” so desperately needed?
