EU Law and Sports Arbitration: When Global and Regional Regimes Meet

Prof Csongor Nagy (University of Galway) will give a webinar titled "EU Law and Sports Arbitration: When Global and Regional Regimes Meet". Prof Nagy has provided the following abstract:

"The CJEU has dealt with the sports industry in a series of cases covering different aspects of its regulation, with the first milestone being Bosman and more recently including the three companion cases European Super League, International Skating Union (ISU), and Royal Antwerp Football Club. In ISU, the Court examined for the first time the mandatory and exclusive nature of CAS arbitration, but only in the context of EU competition law and it did not assess the compatibility of sports arbitration with EU law more generally. It was against this background that RFC Seraing reached the Court, raising questions concerning the legal status and effects of CAS awards and, indirectly, the validity of FIFA arbitration. The case afforded the CJEU an opportunity to clarify the broader implications of its reasoning in ISU and explore general compatibility issues of sports arbitration."
