On 10 October, the ACCPIL will host Dr Stijn van Deursen, Assistant Professor and Postdoctoral Researcher at the Molengraaf Institute for Private Law at Utrecht University. During his vist, he will deliver a guest seminar titled “Repositioning Courts between Litigating Parties, Society and Politics” at 1:00pm in Taylor C49. 

Abstract: In the Netherlands and abroad, courts are increasingly faced with complex cases that carry significant societal and political implications. Many of these issues stem from political inaction, leaving courts to resolve questions that politics has failed to address. In doing so, courts must (re)define their role in relation to three domains: (1) the litigating parties, (2) society, and (3) politics. This is a difficult task, as it requires stepping into uncharted territory. And often, courts are subsequently accused of encroaching on political territory or prioritizing societal goals over litigants’ interests. My research, which frequently draws on methods and perspectives beyond the legal field, examines this triangular relationship. Using empirical approaches, I aim to develop practical guidelines for how courts can navigate through uncharted territory. My short presentation has two main purposes: (1) to introduce my research theme and, (2) to collect international perspectives for my upcoming work on the relationship between courts and politics.
