The Centre for Scots Law is pleased to invite you to our second research seminar this term. Our speaker is Dr Jessica Viven-Wilksch, senior lecturer in law at the University of Adelaide, who will be presenting on: “Scottish and Australian approaches to regulating contract(s): friend or false friend?” The meeting will be hosted in Rm C49 and on Teams. All are welcome to attend.
Dr Viven-Wilksch has provided the following abstract and biography:
Abstract: Contract law is increasingly being shaped by legislation. Australia is an example of this phenomenon, demonstrating an apparent chasm between welfarist interventionism through legislation and liberalist conservatism through case law. On the year of the enactment of the Contract (Formation and Remedies) (Scotland) Act 2026, I am exploring the place of the legislature in regulating contract law. Are Scotland and Australia genuine comparable or are they false friends whose trajectory rest on fundamentally different underpinnings and policy choices? This is an investigative work in progress, allowing me to reflect upon the countries’ approach to regulating contract law.
To start this research, the presentation will ask the following questions: Which parts of contract law are regulated (and which are not)? Who is regulated? How are they regulated? Why is there such regulation in the first place?
One aim is to determining whether there are common themes across both Scotland and Australia? This workshop/presentation will tease out some of the early reflections on the place for legislation in contract law.
Jessica is a Senior Lecturer at Adelaide University where she teaches law relating to commercial transactions, comparative law and private international law. Her research explores the regulation of contractual relationships and commercial conduct, with a focus on good faith and relational contract theory. She is currently a Barbara Kidman Research Fellow and a Visiting Scholar at the University of Strathclyde.
