Course Overview

This course looks at the issues arising from the use of a ship to transport goods from buyer to seller when each is based in a separate legal system and related insurance matters. We examine the contract of affreightment; the relevance of charter parties; the possibilities offered by Bills of Lading and analogous 'documents' (whether electronic or not). We consider the law concerning a cargo claim as it may involve the Hague Rules, the Hague-Visby Rules, the Hamburg Rules. We also look at marine insurance in the context of a cargo claim.

The issues selected for examination in the course vary depending on contemporary developments in the field. However, the indicative topics covered by the course are: the contract of affreightment; charterparties (voyage charterparties and time charterparties; bills of lading, comparing the mandatory rules provided by the Hague Rules, the Hague-Visby Rules and the Hamburg Rules, and marine insurance matters and cargo claims.
