'The Role of the EU in Encouraging Informal Cross-Border Cooperation in International Family Law'
Dr Ruth Lamont from the University of Liverpool will speak on, 'The Role of the EU in Encouraging Informal Cross-Border Cooperation in International Family Law', as part of the 2013-14 Law School Research Seminar Series.
Central Authorities provide a point of contact to coordinate the response to international family law disputes between two different legal systems. States are obliged to establish a Central Authority if they accede to certain international conventions promulgated by the Hague Conference on Private International Law. Recently, the European Union (EU) has adopted a series of measures on international family law which apply between EU Member States and build on the international conventions developed by the Hague Conference. The role of Central Authorities in expediting proceedings and providing support to families involved in international disputes over children has been significantly expanded by the EU legislation. These obligations include facilitation of the exchange and discovery of information about legal provision and measures in national family law, information exchange about the child and their circumstances, encouragement of mediation between parties, supporting issuance of proceedings, facilitation of international cooperation between Central Authorities and other national and international bodies, such as the European Judicial Network. This paper will examine further the nature and extent of the obligations placed on Central Authorities has evolved significantly through the adoption of the EU’s legislation and the evolving role of the Central Authority as an agency of cooperation within the EU.
