UK Supreme Court ruling on legal definition of woman

Dear colleagues,

I am writing to address the recent UK Supreme Court ruling on the legal definition of woman under the Equality Act 2010. The court's decision has clarified that, for the purposes of this Act, the term woman refers to someone born biologically female. While the ruling provides this legal clarification, protection against discrimination for transgender individuals remains.

The University Equality Diversity and Inclusion Committee (EDIC), which I chair, has met and initially discussed this ruling, with a key focus on recognising that the decision may raise questions and concerns within our community and noting the importance of reaching out to staff and students to reiterate our commitment to equality.

In alignment with our Strategic Plan, Aberdeen 2040 and Dignity at Work and Study Toolkit I want to reassure that we are committed to ensuring that all our staff, students, and visitors are treated with respect and dignity and feel safe and included in our institution. Any instances of harassment, bullying, discrimination, victimisation or incivility on the grounds of gender reassignment, sex or any other personal characteristics will not be tolerated.

Working with EDIC and expected guidance from Advance HE and the Equality and Human Rights Commission, we will reflect on the ruling and review its implications including how it affects our policies and procedures.
