"Beneficial Ownership and Control of Energy Transmission Systems"
Dr Monica Waloszyk from the University of Aberdeen will speak as part of the Law School's research seminar series 2014-15 on "Counsel and the Crown: History, Law and Politics in the Thought of David Chalmers of Ormond (ca.1530-1592)".
Abstract
In 2009, RWE AG - one of the major German energy incumbents - offered to divest its gas transmission system as part of a block of commitments envisaged to end the European Commission's competition law investigation in Case COMP/39.402. As a result of the commitments, RWE AG continued to own 25.1% of the transmission system operator. This shareholding ensured that RWE maintained effective beneficial ownership and control of the company holding effective decision-making over third-party access and network development investment strategy. Starting with this premise, the article questions the effectiveness of the European Commission's commitments practice in regulating the behaviour of major energy incumbents towards a respect of market competitiveness, energy consumers' interests and security of energy supply.
